Terms of Service

1. Eligibility

You must be at least 13 years old to use Inkborne. You must be at least 18 years old to access adult or explicit content features. By enabling adult content settings, you confirm you are 18 or older. We reserve the right to terminate accounts we believe belong to minors who have accessed age-restricted content.

2. Your Account

You are responsible for maintaining the security of your account and all activity that occurs under it. Do not share your credentials. Notify us immediately at inkborneai@gmail.com if you suspect unauthorized access.

3. Acceptable Use

You agree not to use Inkborne to:

• Generate content that sexualizes, exploits, or harms minors in any way — this is an absolute prohibition and will result in immediate permanent termination and reporting to appropriate authorities
• Generate content targeting, harassing, or threatening real, identifiable individuals
• Attempt to circumvent safety features, content filters, or access controls
• Use Inkborne to produce spam, disinformation, or content intended to deceive
• Reverse engineer, scrape, or attempt to extract Inkborne's underlying models or prompts
• Resell or sublicense access to Inkborne without written permission
• Use Inkborne in violation of any applicable law or regulation

Adult and explicit content features are provided for professional creative writing purposes — fiction, romance novels, screenwriting, and similar legitimate creative work. You are solely responsible for the content you create.

4. AI-Generated Content Disclaimer

Inkborne uses third-party AI services (Anthropic Claude, OpenRouter) to generate text responses. You acknowledge that:

• AI-generated content is not authored, endorsed, or reviewed by ONX LLC
• AI responses may be inaccurate, inconsistent, or unexpected — they are creative tools, not factual sources
• All characters, scenarios, and dialogue generated are entirely fictional
• You are solely responsible for how you use, publish, or distribute AI-generated content from Inkborne
• ONX LLC is not liable for any AI-generated content that you find offensive, inaccurate, or harmful

5. Third-Party API Keys

Architect tier users may provide their own OpenRouter API key to access additional models. By doing so, you acknowledge that:

• You are solely responsible for all usage and costs associated with your API key
• Content generated through your own API key is entirely your responsibility
• ONX LLC has no control over, and accepts no liability for, content generated through third-party models accessed via your personal API key
• You must comply with OpenRouter's terms of service when using your own key

6. Your Content

You retain ownership of the content you create in Inkborne — your characters, manuscripts, and scenes are yours. By using Inkborne, you grant ONX LLC a limited license to store and process your content solely to provide the service. We do not use your content to train AI models or share it with third parties except as required to provide the service (e.g., sending prompts to Anthropic/OpenRouter to generate responses).

7. Subscriptions and Payments

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize recurring charges to your payment method. You may cancel at any time — your access continues until the end of the current billing period. We do not offer refunds for partial months except where required by law.

We reserve the right to change pricing with 30 days notice. Continued use after a price change constitutes acceptance of the new pricing.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms, particularly for any content involving minors, harassment of real individuals, or other serious violations. You may delete your account at any time by contacting us. Upon termination, your data will be deleted within 30 days.

9. Disclaimer of Warranties

Inkborne is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated content will meet your expectations. Use of Inkborne is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, ONX LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Inkborne, including but not limited to loss of data, loss of revenue, or damages arising from AI-generated content. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah County, Utah.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the site or emailing your registered address. Continued use of Inkborne after changes constitutes acceptance of the updated Terms.
